Terms and Conditions for 3DMations

1. Introduction and Acceptance

3. Service Description and Scope

3DMations provides specialized web application development services for Chartered Financial Analyst (CFA) and Certified Public Accountant (CPA) professionals, incorporating advanced AI technologies [8][9]. Our Services include custom web application development, AI integration for financial analysis and accounting workflows, and ongoing technical support [1][10].

4. Subscription Terms and Payment

4.1 Subscription Plans
Our Services are provided on a subscription basis with monthly or annual billing cycles [7][11]. Specific pricing and features are detailed in your Service Agreement or Order Form [7].
4.2 Payment Terms
Payment is due in advance for each billing period [1][11]. Automatic renewal applies unless terminated with at least 30 days written notice prior to renewal date [12][11]. Late payments may result in service suspension and additional fees [11].

5.3 Compliance
Our Services are designed to assist with compliance requirements relevant to CFA and CPA professionals, including GDPR, CCPA, and financial industry regulations [16][17][15]. However, Customer remains responsible for ensuring their use of our Services complies with all applicable laws and professional standards [3][14].
5.4 Data Breach Notification
In the event of a security incident affecting Customer Data, we will notify Customer within 72 hours and provide detailed information about the incident and remediation steps [3][14].

6. AI Features and Limitations

6.1 AI Service Provision
Our AI Features utilize machine learning algorithms to enhance financial analysis and accounting workflows [5][6]. These features are provided “as-is” and continuously improved through updates [5].
6.2 AI Limitations and Responsibilities
Customer acknowledges that AI-generated outputs may contain errors and should not be relied upon without human review and validation [5][6]. Customer is solely responsible for verifying the accuracy of AI-generated content and ensuring compliance with professional standards [5][6].
6.3 AI Data Usage
Customer Input provided to AI Features remains Customer property, but 3DMations may use aggregated, anonymized data to improve AI algorithms [5][6].

7. Intellectual Property Rights

7.1 Customer Rights
Customer retains all rights to Customer Data and content created using our Services [18][19]. No rights to Customer’s intellectual property are transferred to 3DMations [18].
7.2 3DMations Rights
3DMations retains all rights to our software, AI algorithms, and proprietary technologies [18][19]. Customer receives only a limited license to use our Services as specified in these Terms [18].
7.3 License Grant
Subject to compliance with these Terms, 3DMations grants Customer a non-exclusive, non-transferable license to access and use our Services during the subscription term [18][19].

8. Service Level Agreement (SLA)

8.1 Uptime Guarantee

We strive to maintain 99.5% uptime for our Services, excluding scheduled maintenance [20][7]. Planned maintenance will be announced at least 48 hours in advance [20].

8.2 Support Response Times
Technical support is provided during business hours (9 AM – 6 PM EST, Monday-Friday) with response times of 24 hours for standard issues and 4 hours for critical issues [20][7].
8.3 SLA Remedies
If we fail to meet our uptime guarantee, Customer may be eligible for service credits as outlined in the applicable Service Agreement [20][7].

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 3DMATIONS’ TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY CUSTOMER IN THE 12 MONTHS PRECEDING THE CLAIM [13][21].3DMATIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES [13][21].

10. Professional Services Disclaimer

While our Services are designed for CFA and CPA professionals, 3DMations does not provide financial, accounting, or legal advice [10][9]. Customer is responsible for ensuring compliance with all professional standards, regulations, and licensing requirements applicable to their practice [10][8].

11. Termination

11.1 Termination Rights

Either party may terminate these Terms with 30 days written notice [12][21]. 3DMations may terminate immediately for material breach or non-payment [12].

11.2 Effect of Termination
Upon termination, Customer’s access to Services will cease, and Customer Data will be available for download for 30 days before permanent deletion [12][4].

12. Acceptable Use Policy

Customer agrees not to use our Services for any unlawful purpose, to violate any professional standards applicable to CFA or CPA practice, or to interfere with the security or functionality of our Services [22][1]. Prohibited activities include but are not limited to unauthorized access, data mining, or reverse engineering [22][1].

13. Changes to Terms

3DMations reserves the right to modify these Terms with 30 days advance notice to Customer [1][7]. Continued use of Services after the effective date constitutes acceptance of the modified Terms [1].

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction where 3DMations is incorporated [1][23]. Any disputes will be resolved through binding arbitration in accordance with applicable arbitration rules [1][23]
